1 Overview

CashPulse complies with the Digital Millennium Copyright Act (DMCA) and responds promptly to notices of alleged copyright infringement on user-submitted content, including community posts, reviews, feed posts, and directory contributions.

If you are the copyright owner (or an authorised agent) and you believe content posted on CashPulse infringes your copyright, you can submit a takedown notice using the process below.

2 Designated Agent

Our DMCA designated agent receives all copyright takedown notices:

3 Filing a Takedown Notice

To be effective under the DMCA, your notice must include all of the following. Notices missing required information may be rejected or delayed.

  1. Identification of the copyrighted work claimed to have been infringed. A clear description of the original work, with a URL to the original if available.
  2. Identification of the allegedly infringing material on CashPulse, with enough detail for us to locate it โ€” ideally the specific URL(s) on cash-pulse.app.
  3. Your contact information: full legal name, postal address, telephone number, and email address.
  4. A good-faith statement that you believe in good faith that the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. A perjury statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the owner.
  6. Your physical or electronic signature. A typed full name at the end of the email counts as an electronic signature.

4 What Happens Next

Upon receipt of a valid notice, we will typically:

We aim to acknowledge valid takedown notices within 3 business days.

5 Counter-Notice Procedure

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice. Send your counter-notice to support@cash-pulse.app (subject line: "DMCA Counter-Notice") with:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the URL where it used to appear.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, postal address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the U.S., the Northern District of California), and that you will accept service of process from the person who filed the original takedown notice.

If we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a lawsuit seeking a court order against you within 10โ€“14 business days, we may restore the removed material.

6 Repeat-Infringer Termination

In accordance with the DMCA and our Terms of Service, CashPulse maintains a policy of terminating the accounts of users who are determined to be repeat copyright infringers. We may also suspend accounts at our discretion where there is strong evidence of infringement.

Three-strike guideline: Generally, users who receive three or more valid DMCA takedown notices within a rolling 12-month period will have their accounts terminated. We evaluate each case individually and reserve the right to act sooner in clear cases of bad-faith infringement.

7 False Claims

Under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please make sure your claim is accurate before submitting a notice or counter-notice.
